1. Acceptance of terms

By accessing or using News Brain (the “Service”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” refers to the organization.

These Terms should be read together with our Privacy Policy and Cancellation Policy. The Service is operated by Brahm Byte Technologies.

2. The service

News Brain provides tools to create and operate digital news portals, including content management, publishing workflows, domains or subdomain hosting options, branding controls, and related features described on our website or in your dashboard.

Features may vary by plan and may change as we improve the product. We may update, add, or remove functionality with reasonable notice where a change materially reduces core paid features, except where immediate change is needed for security, legal, or operational reasons.

3. Accounts and responsibilities

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including actions by team members you invite.

You are solely responsible for content published through your portals — including articles, images, videos, comments you choose to enable, and advertisements — and for compliance with journalism ethics, copyright, defamation, privacy, and applicable local laws.

Notify us promptly at the support address below if you suspect unauthorized access or a security incident involving your account.

4. Acceptable use

You agree to use the Service only for lawful publishing and business purposes. You must not misuse the platform.

• Do not upload or publish unlawful, harmful, defamatory, fraudulent, or infringing content
• Do not attempt unauthorized access to systems, accounts, data, or networks
• Do not interfere with platform availability, security, performance, or other customers’ portals
• Do not use the Service to send spam, phishing, malware, or engage in abusive automation
• Do not scrape, reverse engineer, or circumvent usage limits, security controls, or billing measures except as permitted by law
• Do not misrepresent your identity or affiliation in a way that deceives readers or other users of the Service

5. Your content and ownership

You retain ownership of the content, branding, and materials you upload or publish through your portals (“Customer Content”).

You grant Brahm Byte Technologies a limited, worldwide, non-exclusive license to host, store, process, transmit, and display Customer Content solely as needed to provide and support the Service (including backups, CDN delivery, and moderation or abuse review where necessary).

You represent that you have the rights needed to publish Customer Content and that it does not violate third-party rights or applicable law. We may remove or disable content that we reasonably believe violates these Terms or the law.

6. Subscriptions and billing

Paid plans are billed according to the pricing shown at checkout or in your dashboard. Fees may be charged monthly, annually, or on another cycle stated for your plan. Applicable taxes may be added.

Subscriptions renew automatically at the end of each billing period unless you cancel as described in our Cancellation Policy. Failure to pay may result in suspension or termination of access. Refunds, if any, are governed by the Cancellation Policy.

7. Intellectual property

The News Brain platform, software, documentation, trademarks, logos, and underlying technology remain the exclusive property of Brahm Byte Technologies or its licensors. These Terms do not transfer any ownership of the platform to you.

You may not copy, modify, distribute, sell, lease, or create derivative works of the Service except as expressly allowed in writing. Feedback you provide may be used by us to improve the product without obligation to you.

8. Third-party services

The Service may integrate with or rely on third-party providers (for example payments, email delivery, analytics, or domain registrars). Your use of those services may be subject to their own terms and privacy policies.

We are not responsible for third-party services we do not control, except to the extent required by law or expressly stated in a written service commitment.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

News Brain is a publishing and hosting platform. We do not control editorial decisions made by customers and do not warrant the accuracy of Customer Content published on customer portals.

10. Limitation of liability

To the fullest extent permitted by law, our total aggregate liability arising from or related to the Service is limited to the fees you paid to us for the Service in the three (3) months preceding the claim.

We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, even if we were advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by applicable law.

11. Indemnity

You agree to indemnify and hold harmless Brahm Byte Technologies and its officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may cancel your subscription as described in our Cancellation Policy. We may suspend or terminate access for unpaid invoices, Acceptable Use violations, legal risk, or material breach of these Terms.

Upon termination, your right to use the Service ends. We may offer a reasonable data export window; after that, Customer Content may be deleted according to our retention practices. Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) will survive termination.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Courts in Bengaluru, Karnataka, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, unless mandatory consumer protection law provides otherwise.

14. Changes to these terms

We may update these Terms periodically. Material changes will be reflected on this page with a revised “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to updated Terms, you should stop using the Service and cancel any active subscription under the Cancellation Policy.
